Terms of Service

Please read these Terms of Service carefully before using SportsMonkey. By creating an account, browsing the app, creating a team, joining a game, accepting a challenge, or otherwise using SportsMonkey, you agree to these terms.

1. About SportsMonkey

SportsMonkey is a sports coordination platform that helps individuals and teams organise pickup games, issue and accept challenges, manage RSVPs, and share game information. SportsMonkey is a technology platform only. We are not a venue operator, referee, coach, medical provider, sports governing body, transport provider, insurance provider, or payment collection agent for launch-version pickup games.

2. Eligibility and Account Responsibility

You must be at least 18 years old to create an account or use SportsMonkey. By registering, you confirm that the information you provide is accurate, current, and complete.

You are responsible for keeping your account secure, for all activity under your account, and for notifying SportsMonkey promptly if you believe your account has been accessed without permission.

3. Physical Activity and Assumption of Risk

Sports activities involve inherent risks, including collision, falls, dehydration, equipment failure, unsafe venues, misconduct by other participants, serious injury, permanent disability, or death. By organising, joining, attending, or participating in any activity through SportsMonkey, you voluntarily assume all risks connected with that activity.

SportsMonkey does not verify the safety of venues, the fitness level or skill of participants, the adequacy of equipment, weather conditions, medical readiness, or the conduct of any individual. To the maximum extent permitted by law, you release SportsMonkey, its owners, officers, employees, contractors, and affiliates from liability for injury, illness, property damage, loss, or death arising from activities organised through the platform.

4. User Conduct

You agree to use SportsMonkey lawfully, honestly, and respectfully. We may restrict, suspend, or terminate accounts that create safety, fraud, abuse, privacy, or platform-integrity risks.

  • Do not harass, threaten, stalk, discriminate against, or abuse other users.
  • Do not impersonate another person, create fake teams, manipulate player counts, or falsify game records.
  • Do not organise illegal activity, unsafe activity, gambling, violence, or activity that violates venue rules.
  • Do not post offensive, infringing, misleading, or private information about others.
  • Do not attempt to bypass security controls, scrape the service, reverse engineer the app, or overload the platform.
  • Do not repeatedly no-show, misuse invites, or disrupt games after accepting.

5. Teams, Challenges, and Game Commitments

Team admins are responsible for managing their team roster, accepting or passing on team challenges, communicating with their players, and ensuring the team understands game details before committing.

Individual pickup admins are responsible for creating accurate game details, monitoring participation, and cancelling games if appropriate. Players are responsible for checking date, time, location, cost information, cancellation policy, and game notes before accepting.

6. Contributions, Offline Payments, and Wallet Features

For the launch version, any contribution amount shown in a pickup game or challenge is informational only. SportsMonkey does not require in-app wallet funds to accept or participate in pickup games, and users must coordinate any payment outside the app unless a future in-app payment feature is expressly enabled.

SportsMonkey is not responsible for collecting, refunding, enforcing, or resolving offline payments between users, teams, venues, or organisers.

7. Cancellations, Attendance, and Disputes

Games may display a cancellation policy selected by the organiser. Users remain responsible for communicating respectfully and in good faith when cancelling, leaving, or changing availability.

SportsMonkey may provide tools to record attendance, RSVPs, game status, team split, and lineups, but we do not guarantee the accuracy of user-submitted information and do not adjudicate every dispute between users or teams.

8. User Content and Licence

You retain ownership of profile photos, team logos, names, messages, notes, and other content you submit. You grant SportsMonkey a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and process that content as needed to operate, improve, secure, and promote the service.

You must have the right to upload any content you submit. We may remove content that violates these terms or creates legal, safety, privacy, or platform-integrity risk.

9. Privacy and Data Protection

SportsMonkey handles personal information according to our Privacy Policy. By using the platform, you acknowledge that your display name, profile photo, team memberships, RSVP status, game participation, and team role may be visible to relevant users as described in the Privacy Policy.

10. Suspension and Termination

You may delete your account from Profile > Privacy & Security. We may suspend, restrict, or terminate your account if you violate these terms, create risk for other users, misuse the platform, or if required by law.

After account deletion, your public profile is hidden immediately. Certain records may be retained for up to 12 months for legal compliance, dispute resolution, fraud prevention, safety, and security purposes, then deleted or anonymised as described in the Privacy Policy.

11. Disclaimers and Limitation of Liability

SportsMonkey is provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted access, error-free operation, availability of games or opponents, venue quality, user conduct, or that any game will proceed as planned.

To the maximum extent permitted by law, SportsMonkey is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, loss of profits, lost data, personal injury, property damage, or disputes between users. SportsMonkey's total liability for any claim is limited to the amount you paid directly to SportsMonkey in the 90 days before the claim, or AED 100 if you paid nothing directly to SportsMonkey.

12. Indemnity

You agree to defend, indemnify, and hold SportsMonkey, its owners, officers, employees, contractors, and affiliates harmless from claims, losses, liabilities, damages, costs, and expenses arising from your use of the platform, your participation in any activity, your content, your breach of these terms, your violation of law, or your dispute with another user, team, organiser, or venue.

13. Governing Law

These terms are governed by the laws of the United Arab Emirates. Any dispute arising under or relating to these terms or the SportsMonkey platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless mandatory consumer law requires otherwise.

14. Changes to These Terms

We may update these terms from time to time. We will update the 'Last updated' date and, for material changes, may notify users in the app or by email. Continued use of SportsMonkey after the updated terms become effective means you accept the updated terms.
